Article 1. Rates

The prices indicated are per accommodation (room, bed, etc.) or other services, for the number of person(s) and date(s) previously selected, unless otherwise stated (packages)

The conversion into the client’s currency is given as an indication and is not contractual. Any costs related to the conversion between the hotel’s currency and the client’s currency (exchange rates, bank charges) are the responsibility of the client.

* Unless included in the price or specifically selected at the time of booking, additional services (breakfast, surfing lessons, bike hire, etc.) are optional and must be paid for on site.

Taxes are included in the price or indicated in the tax details. However, some additional taxes may be charged upon arrival at the hotel according to local regulations.

Article 2. Bookings

Our hotel has a real time reservation system which is updated instantly. As soon as you have confirmed your reservation, you will receive a confirmation email. Please print out your booking confirmation which you will receive by email. This confirmation will be requested by the hotel when you check in.

The Hotel de la Plage may modify the rates of the various rooms at any time without this modification having any consequence for the Client who will, in any case, be invoiced the rate in force on the day of his reservation, except for modification of the taxes in force or introduction of new taxes.

Article 3. Terms of Payment

By logging on to www.hotel-hossegor.fr you can make a reservation directly at the hotel.

Our hotel has a real time reservation system which is updated instantly. As soon as you have confirmed your reservation, you will receive a confirmation email. Please print out your booking confirmation which you will receive by email. This confirmation will be requested by the hotel when you check in.

The Hotel de la Plage may modify the rates of the various rooms at any time without this modification having any consequence for the Client who will, in any case, be invoiced the rate in force on the day of his reservation, except for modification of the taxes in force or introduction of new taxes.

  • 1. In the case of a long-stay reservation or several rooms at the same time: Between 20% and 30% of the amount of the stay will be charged at the time of reservation. The balance of the amount of the stay can be paid by the customer directly on the spot at the arrival and or at the departure with the means of payment of his choice.

  • 2. Non-cancellable – non-refundable reservations:

    In the case of a non-cancellable – non-refundable reservation: the hotel will debit the total amount of your reservation upon confirmation (excluding tourist taxes).

  • 3. Means of payment :

    Credit cards accepted for online payment: Master, Visa. American Express.

    On site: cash, cheques, ANCV holiday vouchers, credit cards 

    For all payments made with American Express, additional charges may be applied.

    This list is subject to change.

    When ordering, you must mention your credit card number and its validity date. The card must be valid on the date of departure of the client’s stay. In case of invalid credit card details, the hotel reserves the right to cancel the reservation immediately and without notice.

    Our booking system is secure and your credit card number and personal details are safe.

    The hotel may also ask you to show proof of identity in order to prevent credit card fraud.

  • 4.  If the Client has not prepaid their stay online, the Establishment may ask the Client, upon arrival, for a security deposit or an authorisation to debit the bank card (also known as a “pre-authorisation”) in order to guarantee payment of the sums corresponding to the services consumed on site.

Article 4. Booking Guarantee – Check-in et Check-out

The Hotel de la Plage is open from 7am to 8pm, 7 days a week.

The reservation is officially effective from 3pm on the day of arrival and ends at 12pm on the day of departure.

Early Arrival – Late Departure: subject to availability, the Client may request access to their room before 3pm on the day of arrival or to keep their room after 12pm and until 4pm on the day of departure. This service can be arranged on site with the hotel staff or on request, subject to an additional charge and availability. Article 5. Pets

The establishment accepts medium-sized pets (not exceeding 7kg).

The pet supplement is a flat rate of 20€/pet, for the whole stay.

Article 6. Create your ” Hôtel de la Plage ” account

On the HOTELS site, the client has the possibility of creating a Club account.

Via his Club account, the Client can, in particular:

Modify his personal information;
Access the summary of his current reservations and previous stays;
Contact and communicate with Customer Service;
Benefit from commercial advantages.

Article 7. Cancellation or modification of a service reservation

For the Accommodation Services (reservation of rooms within an Establishment or other types of accommodation), the Client is reminded that he/she does not have the right of withdrawal provided for in Article L. 221-18 of the Consumer Code, and this in accordance with Article L. 221-28 paragraph 12 of the Consumer Code which excludes this right for contracts relating to the provision of accommodation services which must be provided on a specific date or at a specific time.

For each Service reservation, the Special Conditions specify the terms and conditions for cancelling and/or modifying the reservation.

Deposits (sums paid in advance) will not be refunded if the client does not cancel within the time limits mentioned. In this case, this is mentioned in the Special Conditions.

Where the Special Conditions so permit:

The cancellation of a reservation for a Service can be made directly on the Site via the “Consult or cancel your reservation” section or by contacting the reception by e-mail: contact@hotel-hossegor.fr
For a cancellation of a reservation without charge, it must be made 72 hours before the day of the reservation. After this period, the amount of the deposit paid or the amount of the first night will be retained.
The modification of the reservation of a Service can be made directly with the Establishment, whose contact details, in particular telephone numbers, are specified on the confirmation of the reservation sent by e-mail.
If a Service is interrupted due to the Client’s fault, the full price agreed upon will be collected.

In the case of an Accommodation Service, unless expressly stipulated otherwise in the Special Conditions, the Customer must leave the room in the establishment before the time indicated by the establishment, 12 noon on the day the reservation ends. Except Late Check-out.

When the Client has booked an overnight stay with the possibility of modification, the Client may freely change the date of this overnight stay or the type of room up to 72 hours before the day of the beginning of his/her stay at the hotel, subject to the availability of a room in this hotel. In this case, the rate charged to the Client will be the one in force, at the time of the change, for the new dates and the new room type chosen by the Client. A new quotation will be sent to the Client to validate the new rate.

Article 8. Insurance and liability

The client must inform the establishment of any damage caused by him. The client is responsible for all damage caused by him/her and undertakes, in the event of damage to the premises made available, to bear the costs of repairing the damage.

The hotel reserves the right to charge any undeclared extras or services not invoiced at check-out to the credit card provided at the time of booking.

In particular, by making a definitive reservation for a Service, the Client undertakes to pay the price and to comply with the relevant Special Conditions. Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer shall result in the cancellation of the reservation for the Service at the Customer’s expense, without prejudice to any action that the Hôtel de la Plage may take against the latter;
Any behaviour that is contrary to public morality and order within the Establishment, as well as failure to comply with the Establishment’s Internal Regulations, will lead the manager of the Establishment and/or any other service provider to ask the Customer to leave the premises without any compensation and/or without any reimbursement if payment has already been made. In the event that no payment has been made, the Client must pay the price of the Services consumed before leaving the premises;
The Client also undertakes to ensure that the computer resources made available by the Establishment (in particular the WiFi network) are not used in any way for the purposes of reproduction, representation, provision or communication to the public of works or objects protected by copyright or by a related right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the Intellectual Property Code, where such authorisation is required. The Client is also required to comply with the security policy of the School’s Internet access provider, including the rules for using the security measures implemented to prevent the illicit use of computer resources, and to refrain from any act that would undermine the effectiveness of these measures.

Article 9.  Force majeure

Neither party shall be liable to the other party in the event of non-performance of its obligations resulting from force majeure. It is expressly agreed that force majeure suspends, for the parties, the performance of their mutual obligations and that each party shall bear the costs arising from it. The cases usually recognised by the case law of the Cour de cassation (strikes, attacks, death, etc.) are considered as force majeure. If the case of force majeure lasts for more than thirty (30) days from its occurrence, these General Conditions may be terminated by either party without either of them being entitled to claim damages.

In the event of force majeure or any other exceptional event that prevents the Service from being carried out and in particular prevents the reserved room in the Establishment from being made available to the Client, the Establishment may reserve the right to accommodate the Client, in whole or in part, in an Establishment of equivalent category or to carry out a Service of the same nature, subject to the Client’s prior agreement

In the event of relocation, the choice of establishment will be made by the hotel itself. The hotel will pay for the cost of relocation (additional room rate) except in the case of force majeure as detailed above.

Article 10. Commitment

The entry of the required banking information and the acceptance of these General Conditions and Special Conditions by electronic means constitutes an electronic contract between the parties which is proof between the parties of the reservation of the Service and of the payability of the sums due in execution of said reservation.

The General Conditions and the applicable Special Conditions express the entirety of the obligations of the parties. No other condition communicated by the Client may be incorporated into them.

In the event of a contradiction between the Special Conditions and the General Conditions, the Special Conditions shall be the only conditions applicable to the obligation in question. In the event of a contradiction between, on the one hand, the general conditions of any kind of a partner and, on the other hand, the present General Conditions, the stipulations of the present General Conditions shall be the only ones applicable to the obligation in question.

If one or more stipulations of the General Terms and Conditions are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations shall retain all their force and scope.

The authentic language is French. If the General Conditions are translated into a foreign language, the French language shall prevail over any other translation in the event of a dispute, litigation, difficulty in interpreting or executing these conditions and more generally concerning the relations existing between the parties.

Article 11. Personal data

When the Customer uses the Site, in particular when making a reservation, Hôtel de la Plage processes personal data under the conditions described in the “Confidentiality Policy”.

The Customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers and information by the presence of an asterisk.

If the Customer fails to provide information identified as mandatory, Hôtel de la Plage may not be able to record a reservation, manage the Customer’s participation in the loyalty programme or handle any complaints.

Thus, the information collected in connection with the Customer’s reservation is intended for Hôtel de la Plage, its entities, its partners, its service providers (in particular online payment service providers) and the Establishments for the purposes of making the reservation or taking pre-contractual measures. As long as the guarantees provided for by the applicable regulations have been put in place, the Client’s data may be transferred from Europe to countries which do not ensure, from the European Union’s point of view, an equivalent level of data protection.

The Customer may at any time exercise his rights under the regulations on the protection of personal data. All information relevant for this purpose is given in the “Privacy Policy”.
